1. THESE TERMS OF USE (“Terms of Use”)

1.1. What these Terms of Use cover. These are the terms and conditions on which you are able to use the Safe Driving For Life Online eLearning platform ("SDFL Online"), which is provided to you pursuant to and as a licence (“Licence”) that you or your administrator (“Administrator”) has bought from The Stationery Office Limited (“TSO”), subject to these Terms of Use.

1.2 Why you should read them. Please read these Terms of Use carefully before accepting them. These Terms of Use tell you who we are, how you will be able to use SDFL Online, how you and we may change or end your access to SDFL Online, what to do if there is a problem and other important information. If you think that there is a mistake in these Terms of Use, or if you think that these Terms of Use require any changes, please contact us initially in writing to discuss your concern as per the requirements of Clause 2.3 below. Notwithstanding anything to the contrary, TSO may amend these Terms of Use and change or remove content on the SDFL Online platform/website at any time without notice and or liability. For the avoidance of doubt TSO may refer to itself in these Terms of Use as TSO, We and or Us; references to “You” and or “Your” mean the person accepting these Terms of Use in whatever capacity that may be. Such references can be made in either upper and or lowercase, but their meaning and interpretation will be as stated in this Clause. For the avoidance of doubt, We may at any time, without notice, cause and or liability, refuse, deny, delay and or withhold access to SDFL Online or any parts thereof.

Linking from SDFL

1.3 SDFL may provide links to websites that are managed by government departments and agencies, service providers or other organisations. You will need to make your own independent judgment about whether to use any such independent sites, including whether to buy any products, services or digital content offered by them. We do not have any control over the content on these websites nor is TSO responsible to You for:

Accordingly, You agree to release us from any claims or disputes that may come from using these websites. You should further read all terms and conditions, privacy policies and end user licences that relate to these websites before you use them, your use is at your own risk and liability.

2. INFORMATION ABOUT US AND HOW TO CONTACT US

2.1 Who we are. We are THE STATIONERY OFFICE LIMITED, a company incorporated and registered in England and Wales under registration number 03049649 (“TSO”). Our registered office is at 18 St Andrews Business Park, Norwich, England, NR7 0HR and our VAT number is GB662774703.

2.2 TSO is the official publisher of the Driver and Vehicle Standards Agency ("DVSA") and The Police Foundation (for Roadcraft products). You agree that your use of any DVSA or Roadcraft product will not infringe the rights of or restrict or inhibit the use and enjoyment of such resources, and you further agree that such services have their own terms and conditions which also apply, and you must read these before you use such services. We are also not responsible for the protection of any information You give to these websites, or for any loss or damage that may come from your use of these websites, or any other websites they link to. We do not give any guarantees, conditions or warranties about the accuracy or completeness of any content used by these products and we are not liable for any loss or damage that may come from your use of any DVSA or Roadcraft products and or services.

2.3 How to contact us. Please ensure any mail is sent with proof of delivery and receipt so that we can acknowledge and respond to you accordingly.

2.4 How we may contact you. If we have to contact you we will do so by telephone and or by writing to you at the email address and or postal address that you or your administrator have provided to us. It is your responsibility to ensure that we have received and have Your latest email address, postal address, and telephone number at all times.

2.5 "Writing" includes emails. When we use the words "writing" or "written" in these Terms of Use, this includes emails.

3. YOUR ACCESS TO SDFL Online

3.1 For an individual (namely a person/single user) your access to use SDFL Online will commence when (i) you have paid us and (ii) TSO has acknowledged receipt of your payment of your subscription to SDFL Online (“Effective Date”) and such usage shall continue until the expiry of the paid subscription (“Term”), subject to these Terms of Use.

3.2 For multiple user licence purchases of SDFL Online i.e., for corporate/business users and or organisations (i.e. educational establishments, charities etc.), your subscription terms for any given number of users will commence from the Effective Date namely from activation of each individual licence and will expire in accordance with Term. References to “company” henceforth will include and mean any of the aforementioned groups and bodies stated in this Clause.

3.3 Payment of all fees and charges to TSO under these Terms of Use will be in Great British Pounds Sterling (£); you or your administrator will be responsible for all, and any transactional charges and taxes associated with your purchase of SDFL Online. For the avoidance of doubt the Terms and Conditions of Sale (as amended from time to time and ) as referenced and found at: https://www.safedrivingforlife.info/terms-and-conditions/ incorporate and are subject to these Terms of Use by default.

3.4 You warrant, represent, and undertake to TSO that:

(a) You (whether acting as an individual and or for a behalf of a company and or an organisation) have full capacity and authority to enter into and accept these Terms of Use and to bind yourself and or your company and or business to these Terms;

(b) there are no (legal) actions, suits, proceedings, restrictions and or regulatory investigations pending, or to your knowledge, threatened against you that might adversely affect your ability to accept these Terms of Use; and

(c) You may only purchase SDFL Online if you have reached the age of 18, or if you are 13 years of age or older and this agreement is entered into on your behalf by a person of majority who is capable of entering into such agreements and making them binding upon you (your “Guardian"). In such instances, your Guardian agrees to be bound by, and must ensure that you comply with and bound by these Terms of Use.

3.5 Without prejudice to Clause 3.4 above, it is condition of these Terms of Use that you (and or your users) keep your account details unique, private and secure and that you do not share them with anyone else including within your organisation/company and/or business. If you have been granted Administrator user rights then you are granted permission to manage the rights and access of other paid user accounts who have purchased access to SDFL Online specifically by your organisation/company/business, subject to these Terms of Use. To the extent permitted by applicable law you agree to accept responsibility for all activities that occur under your account, login and password details. Accordingly, to inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be used in an unauthorised manner. You are responsible for ensuring that the details you provide us with are correct and complete, and for informing us of any changes to the information you have provided. You can access and update much of the information you have provided us in the My Account section of SDFL Online My account (safedrivingforlife.info)

3.6 Subject to your compliance with these Terms of Use, you may use SDFL Online on any device (“Device”) for your own personal use, provided always that only one session per account may be in operation at any one time, unless you are an organisation/company/business user that has purchased multiple user licences of SDFL Online from TSO.

3.7 In addition to these Terms of Use, you agree that (if a business/corporate user) your Administrator/s will otherwise have full authority and control in respect of your access to SDFL Online and be able to access, monitor and use the results and outcomes related to your use of SDFL Online. Additional Administrator’s Terms of Use are set out at Clause 12 of these Terms of Use.

3.8 You agree that you will (except where otherwise permitted by these Terms of Use) not:

(a) transfer, rent, lease, sub-license, loan, share, provide or otherwise make available SDFL Online and/or the Materials in any form, in whole or in part, to any person without prior written consent from us (such consent to be provided or withheld at our absolute and sole discretion);

(b) not copy SDFL Online or any of the Materials;

(c) not translate, merge, adapt, vary, alter or modify, the whole or any part of SDFL Online or the Materials, nor permit SDFL Online or the Materials any part of them to be combined with, or become incorporated in, any other programs, except as necessary to use SDFL Online and use the Materials on your Device as permitted in these Terms of Use;

(d) not disassemble, decompile, reverse engineer and or create derivative works based on the whole or any part of SDFL Online and/or the Materials nor attempt to do any such things, except to the extent that (by virtue of sections 50B and 296A of the Copyright, Designs and Patents Act 1988) such actions cannot be prohibited because they are necessary to decompile SDFL Online and/or the Materials to obtain the information necessary to create an independent program that can be operated with SDFL Online or with another program (“Permitted Objective”), and provided that the information obtained by you during such activities:

(i) is not disclosed or communicated without our prior written consent to any third party to whom it is not necessary to disclose or communicate it in order to achieve the Permitted Objective;

(ii) is not used to create any software, eLearning platform, programme, products and or materials substantially similar in its expression and or offering to SDFL Online;

(iii) is kept secure;

(iv) is only used for the Permitted Objective, and

(e) comply with all applicable technology control or export laws and regulations that apply to the technology used or supported by SDFL Online.

3.9 Subject to Clause 3.6 if the Device on which you use SDFL Online is not owned by you, you must have the owner’s permission to do so. You will be responsible for complying with these Terms of Use, whether or not you own the Device.

4. SDFL ONLINE

4.1 Most content on SDFL is subject to Crown copyright protection. For DVSA content: contact DVSA at crowncopyright@dvsa.gov.uk if you want to reproduce a piece of DVSA content but are not sure if it’s covered by Crown copyright or the OGL Open Government Licence (nationalarchives.gov.uk). For Roadcraft content: contact TSO, who manage Roadcraft copyright on behalf of The Police Foundation, for any applications for reproduction of Roadcraft content.

4.2 If a business/organisational user of SDFL Online, You and/or your administrator will be required to declare to us in writing and within 72 hours of our request your name/s and contact details of your administrator and your corresponding proof of payment to us in support and our acknowledgment and confirmation to you of the same.

4.3 SDFL Online provides online access to official DVSA and Roadcraft eLearning products as paid for by you or your administrator and agreed with TSO in advance, including The Official DVSA Guide to Hazard Perception, The Official DVSA Theory Test and Hazard Perception Kit for Car Drivers, The Official DVSA Theory Test and Hazard Perception Kit for Motorcyclists, The Official DVSA Theory Test and Hazard Perception Kit for Drivers of Large Goods Vehicles, The Official DVSA Theory Test and Hazard Perception Kit for Drivers of Passenger Carrying Vehicles, Driver CPC: the Official DVSA Guide for Professional Goods Vehicle Drivers, Driver CPC: the Official DVSA Guide for Professional Bus and Coach Drivers, The Official DVSA Guide to Better Driving, The Official DVSA Theory Test and Hazard Perception Kit for Approved Driving Instructors, Roadcraft and Motorcycle Roadcraft, plus any other eLearning modules/courses published from time to time (“Materials”).The definition of Materials and its contents and the available products cited under it is subject to change, we determine that such change to the Materials could materially impeded your use of SDFL Online we will notify you accordingly.

4.4 It is a condition of these Terms of Use that you (whether as an organisation company/business and or as an individual) undertake at all times to:

(a) keep your SDFL Online account details protected and private at all times and you must not disclose these to any other person, except where we request you to do so;

(b) not use SDFL Online in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these Terms of Use, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, such as viruses, or harmful data, into SDFL Online or any operating system;

(c) not infringe our intellectual property rights or those of any third party in relation to your use of SDFL Online and the Materials, including by the submission of any materials (to the extent that such use is not licensed by these Terms of Use);

(d) not transmit and or allow its organisation/company/business to transmit any materials that are defamatory, offensive or otherwise objectionable in relation to your use of SDFL Online;

(e) not use and or allow its organisation/company/business to use SDFL Online in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users; and

(f) not collect and or allow its company/business to collect and or harvest any information or data from SDFL Online or TSO systems or attempt to decipher any transmissions to or from the servers running SDFL Online.

4.5 SDFL Online has been developed to work across all modern browsers and major operating systems. This includes mobile devices such as iOS and Android smartphones and tablets. Technology is always changing, so your experience of SDFL Online may vary according to the technical capabilities of your browsers and devices, the software installed on the device, and other system resources available. It is the responsibility of each user and/or their organisation to ensure all operating systems have the latest patches installed and all associated software is the latest version. We cannot take responsibility for limitations to the user experience caused by unsupported or outdated devices, browsers, operating systems, or security and antivirus software interfering with the display and execution of SDFL Online and the Materials.

4.6 SDFL Online. SDFL Online and Materials contained on SDFL Online may be relevant for use and education worldwide and you are advised to make your own judgment as to whether SDFL Online is suited to your or your organisation’s needs. However, and for the avoidance of doubt, the Materials on SDFL Online are designed to support safe driving/riding and are the official DVSA revision materials for the driving theory test in Great Britain (as amended from time to time and subject to changes in applicable law).

4.7 Limitations to SDFL Online. SDFL Online is provided for general information and education purposes only. It does not offer advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from taking, any action on the basis of information obtained from SDFL Online. Although we make reasonable efforts to update the Materials on SDFL Online, we make no representations, warranties or guarantees, whether express or implied, that the Materials are accurate, complete, or up to date.

4.8 Back-up of content and data used within SDFL Online. While it is intended that content and data inputted by you into SDFL Online will be stored within SDFL Online’ s system for your use next time you log in, where applicable, your Administrators will be able to access and review and download reports in relation to the content and data that is inputted by you into SDFL Online.

5. SDFL Online - PLATFORM SUPPORT

5.2 Contacting us (including with complaints). If you think SDFL Online is faulty or misdescribed or if you have any questions or complaints or if you wish to contact us for any other reason please email our customer service team at or support@safedrivingforlife.info or call them on 0333 200 2425.

5.3 From time-to-time major software updates may be made to SDFL Online and or the SDFL Online website by third parties utilised by TSO and or by TSO. Such updates (repairs and or maintenance) may affect the functionality on SDFL Online, the SDFL Online website and the delivery of the service thereunder. You agree that it is reasonable to allow TSO time to update SDFL Online and the SDFL Online website and services thereunder platform, together with reasonable time to respond to any queries against such updates which may be and or are out of our direct control and or indirect control.

6. PROVISION OF SDFL ONLINE

6.1 When we will provide SDFL Online. Subject to and without prejudice to any term to the contrary within these Terms of Use, your access to SDFL Online shall commence on the Effective Date and shall continue for the Term unless terminated earlier in accordance with these Terms of Use or our contract with you or, where applicable, your Administrator.

6.2 We are not responsible for events outside our control. If our provision of SDFL Online to you is delayed, or unavailable for a time, caused by an event outside our control, then we will notify you as soon as possible to let you know through a notification message on http://www.safedrivingforlife.info and we will take steps to minimise the effect of the delay but we will not be liable for such delay.

6.3 Your rights if we provide access late. If we delay in providing you access to SDFL Online, or you are unable to access SDFL Online and or SDFL Online is unavailable for whatever reason, if you are a business/organisational user you must first contact your Administrator/s, who will advise as to the reasons for such delay or non-accessibility. If you are a user of SDFL Online for personal use, please contact TSO and we will respond as soon as reasonably practicable.

6.4 What will happen if you do not give required information to us. We may need certain information from you so that we can provide you with access to SDFL Online. If you do not give us this information within a reasonable time of us asking for it, or if you give incomplete or incorrect information, you may not be able to access SDFL Online. We will not be responsible for supplying access to SDFL Online late or not supplying access to SDFL Online at all if this is caused by you not giving us the information, we need within a reasonable time of us asking you for it.

6.5 Reasons we may suspend your access to SDFL Online. We may have to suspend your access to SDFL Online to:

(a) deal with technical problems or make technical changes;

(b) update SDFL Online to reflect changes in relevant laws and regulatory requirements;

(c) make changes to SDFL Online as notified by us to you (see Clause 8).

6.6 Your rights if we suspend your access to SDFL Online. We are not obligated and or required to notify you that we will be suspending your access to SDFL Online, unless the problem is urgent or an emergency in which case we will use our reasonable endeavours to do so, taking into account all relevant circumstances. In all other circumstances TSO will use it reasonable endeavours to contact you in the event of any other form of suspension.

7. DATA AND INFORMATION

7.1 We only use any personal data we collect through your use of SDFL Online in the ways set out in our Privacy Policy, which can be found at https://www.safedrivingforlife.info/privacy/ and which in particular will include (without limitation to other uses set out in our Privacy Policy) using your personal data:

(a) to supply access to SDFL Online to you;

(b) in our administration of SDFL Online;

(c) to analyse your usage of SDFL Online in conjunction with our third-party providers as part of our commitment to ensure that you and your Administrator are fully aware of your usage and user interactions on SDFL Online, including the length of time spent on SDFL Online.

(d) to give you information about SDFL Online, but you may stop receiving this at any time by contacting us.

7.2 Please be aware that internet transmissions are never completely private or secure and that any message or information you send using SDFL Online may be read or intercepted by others, even if there is a special notice that a particular transmission is encrypted.

7.3 By using SDFL Online, you agree to us collecting and using technical information about the Devices you use SDFL Online on and related software, hardware and peripherals in order to improve SDFL Online.

8. OUR RIGHTS TO MAKE CHANGES

8.1 Changes to SDFL Online. From time to time, TSO may change and/or update SDFL Online to:

(a) reflect changes in relevant laws and or any regulatory requirements;

(b) update the Materials;

(c) reflect changes in best practice; and or

(d) implement technical adjustments and improvements, for example to address a security threat, or deal with additional features which we introduce, or update the information contained within SDFL Online.

8.2 These changes may require that we take SDFL Online offline to implement them. As a result, you will not be able to access SDFL Online during such time. We will give you reasonable notice of any such change by notifying you through a notification message on https://www.safedrivingforlife.info/.

9. ENDING YOUR ACCESS TO SDFL ONLINE

9.1 We may end your access to SDFL Online. We may end your access to SDFL Online without liability at any time by writing to you if you in our opinion and determination:

(a) breach, threaten or do not accept these Terms of Use; or

(b) you do not, and or your Administrator does not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide you with access to SDFL Online; or

(c) you or your Administrator breaches its contract with us or these Terms of Use; or

(d) you or your Administrator requests that we terminate its Licence and or your access to SDFL Online; or

(e) you are in breach of any applicable laws; and or

(f) we consider that a continued relationship with you in any capacity is prejudicial to our commercial and or reputational interests and that of any parties we represent.

9.2 We may withdraw SDFL Online. Without prejudice to Clause 9.1 above, we are able to provide SDFL Online to you pursuant to agreements we have with certain third parties. In the event that any one of those agreements terminates or expires, we will write to you or your Administrator, as applicable, to advise that we are going to stop providing SDFL Online at least fourteen (14) days in advance of our stopping access to SDFL Online. Where you have an Administrator, it will be the responsibility of your Administrator to notify you that we have stopped providing SDFL Online.

10. OUR RESPONSIBILITY FOR LOSS OR DAMAGE SUFFERED BY YOU

10.1 We are only responsible to you for any proven, reasonable and foreseeable, loss or damage caused directly by us. The Consumer Rights Act 2015 (as amended) says goods and digital content must be as described, fit for purpose and of satisfactory quality. If we fail to comply with these Terms of Use, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms of Use or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time you accepted these Terms of Use, both we and you knew it might happen, for example if you discussed it with us before accepting these Terms of Use.

10.2 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; or for breach of your legal rights in relation to SDFL Online as set out in these Terms of Use.

10.3 If any defective digital content which we have supplied damages any device and or any digital content belonging to you, and this is caused and proven by a court of law in England and Wales to have arisen from our sole, negligent and direct failure to use reasonable care and skill we will either repair the damage or pay you reasonable compensation as we determine. However, we will not be liable for any damages which you could have avoided by following our advice to apply an update offered to you free of charge, or for damage which was caused by you failing to correctly follow installation instructions, or through your usage of SDFL Online in manner that is contrary to these Terms of Use.

10.4 We are not liable to You (in any capacity) for any loss or damage that may come from using SDFL Online. This includes any direct, indirect, special, and or consequential losses, any loss or damage caused by civil wrongs (‘tort’, including negligence), breach of contract or otherwise, the use of SDFL Online and any websites that are linked to or from it and/or the inability to use SDFL Online and any websites that are linked to or from it. This exclusion applies if the loss or damage was foreseeable, arose in the normal course of things or you advised us that it might happen. This includes (but is not limited to) the loss of your:

11. INTELLECTUAL PROPERTY RIGHTS

11.1 All intellectual property rights in SDFL Online and the Materials therein throughout the world belong to us (or our licensors) and the rights in SDFL Online are licensed (not sold) to you subject to these Terms of Use. You have no intellectual property rights in, or to, SDFL Online and the Materials therein, other than the right to use them in accordance with these Terms of Use.

11.2 SDFL Online contains all official DVSA theory test revision questions and answers, and official hazard perception practice clips from the Driver and Vehicle Standards Agency (DVSA). These are published with the permission of DVSA on behalf of the Controller of HMSO. Roadcraft content is copyright of The Police Foundation. No part of SDFL Online may be reproduced in any material form without the written permission of the copyright owner except in accordance with the provisions of the Copyright, Designs and Patents Act 1988 or under the terms of a licence issued by the Copyright Licensing Agency Ltd. Crown Copyright material is reproduced with permission of the Keeper of the Public Record.

11.3 Subject to your, whether as individual, company and or as an Administrator, compliance with these Terms of Use, we and/or our licensors grant you a limited, non-exclusive, severable, non-sublicensable licence to access and make personal and non-commercial use of the Materials on SDFL Online. Exploiting the Materials for any commercial purpose is strictly forbidden.

11.4 You must not modify any of the Materials you have received from us, printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

11.5 You do not have the right to, and you undertake to us that you will not at any time:

(a) resell and or make commercial use of SDFL Online or the Materials that is in contravention to these Terms of Use;

(b) collect and/or make use of any Platform listings, descriptions, or prices;

(c) create any derivative use of SDFL Online or its Materials;

(d) download or copy account information for the benefit of another merchant;

(e) use data mining, robots, or similar data gathering and extraction tools; and/or

(f) otherwise exploit the intellectual property in SDFL Online or the Materials.

11.6 If you breach the provisions of this Clause 11 your access to SDFL Online will cease immediately and you must immediately, at our option, (i) return and or destroy any copies of the Materials you have made, together with (2) indemnifying us on demand for any costs, including any legal costs, damages and or expenses we incur arising from you breach of Clause 12 or any parts thereof.

12. ADMINISTRATOR TERMS

12.1 You acknowledge and agree that Administrators will have rights and obligations in addition to these Terms of Use, as set out in this Clause 12 but subject always to an overarching limitation that Administrators’ activities shall be limited to the administration of their users’ accounts, use and learning on SDFL Online.

12.2 If you are an Administrator, you acknowledge and agree that in addition to these Terms of Use, you will also have the following rights and obligations:

(a) ability to view your users’ progress through the Materials at a high-level, which includes a list of your users, progress reports detailing how many modules/courses individual users have completed and reviewing user scores across the modules/courses;

(b) add and remove your users and edit their SDFL account details;

(c) view SDFL Online licence information in respect of your users; and

(d) ability to download management reports and more granular data in the form of .CSV Excel reports.

12.3 Administrators shall refrain from engaging in any activity that would compromise the reputation of DVSA, The Police Foundation and SDFL Online and/or The Stationery Office Limited (TSO) and/or compromise the value of the Materials and, for the avoidance of doubt, shall remain fully liable and responsible for their users’ compliance with this Clause 12.3 and these Terms of Use in general.

13. OTHER IMPORTANT TERMS

13.1 We may transfer these Terms of Use to someone else. We may transfer our rights and obligations under these Terms of Use to another organisation. We will contact you to let you know if we plan to do this.

13.2 You need our consent to transfer your rights to someone else. These Terms of Use give you the right to use SDFL Online, for personal or business/organisational use, in accordance with these Terms of Use. You may only transfer your rights or your obligations under these Terms of Use to another person if we agree to this in writing and in advance.

13.3 Nobody else has any rights under these Terms of Use. No other person shall have any rights to enforce these Terms of Use.

13.4 If a court finds part of these Terms of Use illegal, the rest will continue in force. Each of the paragraphs of these Terms of Use operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

13.5 Even if we delay in enforcing these Terms of Use, we can still enforce it later. 13.6 Which laws apply to these Terms of Use and where you may bring legal proceedings. These Terms of Use are governed by the laws of England and Wales, and you can bring legal proceedings in respect of these Terms of Use in the courts of England and Wales. If you live in Scotland, you can bring legal proceedings in respect of these Terms of Use in either the Scottish or the English courts. If you live in Northern Ireland, you can bring legal proceedings in respect of these Terms of Use in either the Northern Irish or the English courts.

Please check these Terms of Use regularly. We can update them at any time without notice. You’ll agree to any changes if you continue to use SDFL Online after the Terms of Use have been updated.
